01Who sells

VIZARRA LLC, a Texas limited liability company (in formation), sells the works on vizarrastudio.com. The works are made by hand in our workshop in Vizarrón de Montes, Querétaro, Mexico, and delivered in Texas.

VIZARRA LLC takes the payments for its works itself, through its own Stripe account. No other company collects them on its behalf.

Contact: hello@vizarrastudio.com. Postal address and phone: to be published once the company is registered.

Our sales representatives and consultation agents are independent. They can explain these terms, but they cannot change them or promise you anything VIZARRA has not put in writing.

How we use your data is explained in our Privacy notice.

02One of one, and similar pieces

Every work in the catalogue is made once. When the deposit for a work is paid, it is reserved for that buyer and shown on the site as sold. We do not make a second copy of a catalogue work.

If a work is sold, you can commission a similar piece: a new handmade project in the same spirit, with its own design, number and quote. It is not a copy, and it will differ from the sold work.

Made-to-measure pieces and custom configurations (other dimensions, stones or finishes) are quoted in writing. You approve the quote, with its drawings or renders, before any deposit is taken.

03Prices and currency

Prices are in US dollars (USD).

Catalogue prices are landed in Texas: they include crating, freight from Mexico, customs and cargo insurance to our receiving point in Texas.

They do not include delivery and installation in your space (section 7) or sales tax, which is added where it applies. If you hold a resale or exemption certificate, send it to us before you pay.

The price that applies is the one shown when you pay your deposit, or the one in your written quote. If a price on the site is an obvious error, we tell you, and you may confirm at the correct price or cancel with a full refund.

04How a reservation works

You must be 18 or older to place an order.

  • Deposit. You reserve a catalogue work by paying 50% of its price on the site, through Stripe Checkout. Before you pay, the site shows the deposit terms for that work (price, deposit, balance, the date and time your change-of-mind window closes, the ship date and our contact details), and you accept them on their own. While checkout is open, the work is held for you for about 30 minutes; if the payment is not completed, it becomes available again.
  • Bank payments. If you pay the deposit from a US bank account (ACH), your bank takes a few business days to confirm it. Meanwhile the work stays held for you, for up to 5 business days, and we confirm your order when the payment clears. If your bank does not complete the debit, we tell you by email and the work becomes available again.
  • Confirmation. We confirm your order by email with the work, the price, the deposit paid, the balance, the date by which the work will leave the workshop, the date and time your change-of-mind window closes, and the version of these terms.
  • Your stone. Where the work allows it, we show you photographs of the actual slab before cutting.
  • Balance. When your work has passed our quality check, we send you photographs and ask for the remaining 50%, plus delivery and any sales tax. The balance is due within 14 days of that request, and always before delivery.
  • Paying the balance. By card through Stripe, or by bank transfer.

If two payments ever arrive for the same work, the first completed payment keeps it and the other is refunded in full.

05If the balance is not paid

We keep a finished work for you at no cost for 30 days after we ask for the balance.

If the balance is still unpaid, we write to you at least twice. If it remains unpaid 30 days after the due date, we may cancel the order, keep from the deposit the documented cost of the work, materials and storage, refund you the rest, and offer the work for sale again.

06Cancellations and refunds

  • Change of mind. You can cancel for a full refund of your deposit within 72 hours of paying it. The exact date and time this window closes is shown before you pay and in your confirmation, in US Central time; it is never earlier than 72 hours after your payment. We do not start cutting your work during those 72 hours unless you ask us to in writing.
  • After 72 hours. Once work has started, you can still cancel at any time before delivery. We refund what you paid minus the documented cost of the stone, materials and work done up to the day you cancel, and send you the breakdown.
  • Made to measure. Stone cut to your measurements cannot be used for anyone else. For made-to-measure and custom pieces, once the stone has been cut, the deposit is no longer refundable.
  • If we cancel. If we cannot make your work as agreed (for example, if the stone fails during carving), we tell you at once and you choose: a new slab with a new date, or a full refund of everything you paid.
  • Delays. You may also cancel for a full refund if we cannot ship on time (section 8).
  • Buying at home. If you sign an order in your home or away from our place of business, for example with a representative or during a consultation visit, you may cancel it within three business days for a full refund. You receive a written notice of this right when you sign.

To cancel, write to hello@vizarrastudio.com with your order number. Refunds go back to your original payment method within 7 business days; your bank may take a few more days to show them.

07Delivery and installation

Delivery and installation by our white-glove crew are billed separately, by the weight of the work and the city:

  • $300 USD plus $0.45 USD per kilogram of the work's weight;
  • plus $1,500 USD for rigging when a work weighs more than 700 kg;
  • Austin is the base price; Dallas +10%, Houston +5%;
  • other places in Texas, and outside Texas, are quoted on request.

Each work page shows an estimate. The final delivery charge is confirmed with the balance request.

Before delivery, tell us about access: stairs, lifts, door widths, the path from the street and the floor where the work will stand. Many works weigh hundreds of kilograms, and some several tonnes. You are responsible for confirming that the floor or structure can carry the weight; for heavy works we recommend a structural engineer's check. If access is different from what you told us and extra crew or equipment is needed, we quote it before doing the work.

We agree the delivery date with you. If no one is there at the agreed time, or the space is not ready, a new visit may be charged.

08Lead times and delays

Workshop time is between 3 and 45 days depending on the work; each work page states it. Once a work leaves the workshop, delivery in Texas typically takes 3 to 5 weeks (freight, customs and scheduling).

The deposit terms you accept and your order confirmation state the date by which your work will leave the workshop: the ship date. For a catalogue work reserved on the site, it is no later than 8 weeks after your deposit, which leaves time to choose your slab and for the workshop's queue. We only give dates we have good reason to meet.

If we see that we cannot meet the ship date, we write to you before it passes, give you a new date if we have one, and you choose: accept the delay, or cancel for a full refund of everything you paid.

If the new date is no more than 30 days later and you do not reply, we take that as accepting the delay. If the delay is longer, or we cannot give a date, we need your clear agreement; without it, we cancel the order and refund you in full. Any further delay also needs your agreement.

Until your work has left the workshop, you may cancel at any time during a delay, with a full refund.

After shipping, freight or customs can slow the journey. We keep you informed and confirm the delivery appointment with you.

09Inspection and damage on delivery

Inspect the work with our crew when it is installed. Note any visible damage on the delivery receipt and take photographs.

If you find damage that could not be seen at delivery, tell us within 7 days, by email with photographs.

If a work arrives damaged, we repair it; if a repair would not restore it, we remake it or refund you in full, as you prefer.

Natural features of the stone and the patina of bronze are not damage (section 11).

10Risk and ownership

We carry the risk of loss or damage until the work is delivered to you. If our crew delivers and installs it, the risk passes to you when installation is complete. If you collect the work or send your own carrier, it passes when the work is handed over at our receiving point in Texas.

The work becomes yours when it has been paid in full.

Buying a work gives you the physical piece. VIZARRA keeps the rights in its designs, drawings, renders, models and photographs. You may photograph your work and show it freely.

11Natural stone, metals and renders

Each work is cut from natural stone and finished by hand. Veins, colour, fossils, pores, small natural fissures and filled voids differ from slab to slab and from the images. They are the character of the stone, not defects.

Bronze, copper and steel are finished by hand; their patinas vary and keep changing with time, light and touch. That change is part of the piece.

Images on the site are renders of VIZARRA designs, not photographs of the finished work. Colours also vary from screen to screen.

Dimensions may differ from those shown by up to 1 cm or 1%, whichever is greater. Weights are estimates.

12Limited Warranty

This Limited Warranty is given by VIZARRA LLC ("we") to the person who bought the work from us, the original buyer. It cannot be transferred: it ends if the work is sold or given to someone else.

  • Stone: lifetime structural warranty. It covers the stone of the work if it cracks or breaks because of a defect in the stone or in our workmanship, under normal use. "Lifetime" means for as long as the original buyer owns the work.
  • Metal and wood: five years, against defects in materials and workmanship, such as a failed weld, joint or fixing.
  • When it starts. Both warranties start on the day the work is delivered to you.

What we do: we repair the work or, if a repair would not restore it, remake it. We pay for the materials and the work, and for moving the piece to and from your home in Texas when a repair needs it.

Not covered: impact, misuse, overloading, moving or installation by others, structural movement of the building, outdoor use of works not made for it, etching or stains from acids, wine, citrus or cleaning products, normal wear, and the natural character of the materials: veins, colour, fossils, pores, small natural fissures and filled voids in the stone, and the patina of bronze, copper and steel, which keeps changing.

  • 1. Write to us within the warranty period at hello@vizarrastudio.com, or by mail to VIZARRA LLC, Warranty, at our postal address (to be published once the company is registered), with your order number, a description of the problem and photographs.
  • 2. We answer within 10 business days and, if needed, arrange a visit to inspect the work.
  • 3. We agree a date with you and our crew repairs or remakes the work. Warranty work is done only by VIZARRA or the people it sends.

This warranty does not limit any implied warranty, such as the implied warranties of merchantability and of fitness for a particular purpose.

Under this warranty we are not responsible for incidental or consequential damages (see also section 16). Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.

13Care

  • Wipe spills at once, especially wine, coffee, citrus and oil. Use coasters and trays.
  • Clean stone with a soft cloth and water, or a pH-neutral stone cleaner. Never use vinegar, lemon, bleach or abrasive products.
  • Marble, travertine and limestone benefit from a fresh sealer about once a year; we tell you which product to use.
  • Bronze and copper: dust with a dry cloth; a little microcrystalline wax every few months keeps the patina even.
  • Stainless steel: mild soap and water, dried with a soft cloth.
  • Wood: keep it away from heat sources and long hours of direct sun; wipe with a barely damp cloth.
  • Move heavy works only with proper equipment, and ask us before you move them.

14Private consultation

A private consultation costs $800 USD, paid in advance through Stripe.

A VIZARRA agent visits your space, takes measurements and proposes placement, dimensions and stone. Visits are offered in Austin, Dallas and Houston; elsewhere, travel is quoted first.

During the consultation we show you renders of the proposals. They are delivered to you only once the piece is paid in full, and they remain VIZARRA's intellectual property: you may use them for your own home and share them with your designer or builder, but not to have the design made by someone else.

The consultation does not oblige you to buy. If you order a piece within 90 days of the visit, the $800 USD is credited against its price.

You may reschedule once at no cost, or cancel for a full refund, up to 48 hours before the visit. After that, or once the visit has taken place, the fee is not refundable.

When you book, you accept these terms, including this section; the booking form shows these points next to the box you tick.

15Trade-in of hi-fi audio

We may accept high-value hi-fi audio equipment as part of the payment, only with VIZARRA's written approval after we analyse it. A trade-in is never automatic, and we may decline any offer.

If we approve it, we agree the value in writing and credit it against your balance. You confirm that you own the equipment and may sell it. If, on collection, it does not match its description, we may adjust the value or cancel the trade-in, and you then pay that part of the balance by other means.

16Responsibility

We are responsible for loss or damage we cause that was foreseeable when you placed your order. To the extent the law allows, we are not responsible for indirect or consequential losses, and our total responsibility for an order is limited to what you paid for it.

Nothing in these terms limits responsibility that the law does not allow to be limited, such as for death or personal injury caused by negligence, or your rights under the Texas Deceptive Trade Practices–Consumer Protection Act.

17Governing law and disputes

These terms are governed by the laws of the State of Texas and applicable US federal law.

If something goes wrong, write to us first; we will try to resolve it within 30 days.

Any dispute we cannot resolve goes to the state or federal courts in Travis County, Texas, unless the law gives you the right to bring it elsewhere.

These terms are published in English and Spanish. If the two versions differ, the English version prevails.

18Changes and version

We may update these terms. The version you accepted when you paid your deposit applies to your order, and your confirmation records it.
